Canadian Federal Private Sector Privacy Law Reform: Initial Reflections on the Proposed Protecting Privacy and Consumer Data Act


On Monday, June 15, the Federal government introduced a bill containing the Protecting Privacy and Consumer Data Act (PPCDA), a proposed federal private sector privacy statute that will replace the Personal Information Protection and Electronic Documents Act (PIPEDA). 

On Friday, June 19, 2026, at 11:30 am Eastern Time a 1-hour AccessPrivacy Monthly Call, where Partners from Osler's national Privacy and Data Management team provided an initial overview and commentary on the PPCDA. 

Among other things, the PPCDA is expected to introduce:

  • A significantly enhanced enforcement regime, including

    • potential fines of up to 5% of global revenue or $25 million CAD, and
    • power for the Office of the Privacy Commissioner of Canada to issue binding orders;
  • Additional "exception to consent" authorities for the collection, use, or disclosure of personal information for certain defined standard "business activities", and authority for collection or use without consent for the organization's "legitimate interests", subject to strict conditions;

  • A requirement for organizations to implement a privacy management program;

  • Enhancements to individuals' control over their personal information, including provisions requiring organizations, under certain circumstances, to dispose of personal information on request;

  • Enhanced safeguards to protect children's personal information from exploitation or misuse; and

  • Provisions to address harm from the creation of AI-generated "deepfake" images.
