OPC Investigates on Online Behavioural Advertising and Customer Profiling 

The Office of the Privacy Commissioner of Canada (OPC) recently announced that it will be investigating Bell Canada regarding, among other things, its practices with respect to online behavioural advertising and customer profiling.  

 

OIPC Alberta Order regarding Collection & Use of Personal Information from Company-issued Phone

 

The OIPC Alberta recently released a decision regarding the collection and use of information related to an employee's personal telephone calls on a company-issued Blackberry. The OIPC Alberta determined that the organization did not have consent to collect and use such data. Further, the organization could not rely on the exception to the consent requirement for investigations related to a breach of an agreement because there was no policy in place that restricted the employee's ability to make personal calls using the device. 

  

Lawsuit Filed Against Communications Security Establishment Canada

 

The British Columbia Civil Liberties Association (BCCLA) has filed a lawsuit against the Communications Security Establishment Canada (CSEC) claiming that provisions in the National Defence Act regarding the interception, retention and use of private communications of persons in Canada infringes the Canadian Charter of Rights and Freedoms.

 

OPC Follow-up Audit of FINTRAC Reveals Privacy Shortcomings

 

The OPC released an audit report yesterday indicating that the Financial Transactions and Reports Analysis Centre of Canada (FINTRAC) collects and retains personal information longer than required.  The audit followed up on recommendations made to FINTRAC after a 2009 audit.
