Case Involving Union Recording of Picket Line Activities to be Appealed to Supreme Court of Canada

Information and Privacy Commissioner of Alberta Jill Clayton has announced that her office will apply to the Supreme Court of Canada for leave to appeal the Alberta Court of Appeal's decision in United Food and Commercial Workers, Local 401 v. Alberta (Attorney General)

In this case, the Court of Appeal declared unconstitutional the application of Alberta's Personal Information Protection Act to the activities of a union, namely the use of images recorded of individuals at a picket line on the union's website and in union newsletters and leaflets. We will be discussing this development at our annual conference, this Thursday June 7th.
