Proposed PIPEDA Security Breach Regulations Released

A proposed draft of PIPEDA's Breach of Security Safeguards Regulations were published online today, and organizations now have 30 days to comment as part of a formal stakeholder consultation process.

The proposed regulations include specific requirements regarding:

  • the content, form and manner of reporting of security breaches to the Office of the Privacy Commissioner of Canada;
  • the content of security breach notification to affected individuals; and
  • record keeping.

The Canadian privacy arena will be significantly impacted by PIPEDA's new security breach notification regime.  AccessPrivacy will be hosting a Security Breach Notification Regulations Workshop on Friday, September 8, 2017.  Through a moderated discussion, we will explore the meaning and impact of the draft breach regulations with a view to assisting organizations in the preparation of their written comments as part of the consultation process, and in the enhancement of security incident response protocols.

The draft security breach regulations were developed by Innovation, Science and Economic Development Canada (ISED) after a consultation process, and Jill Paterson (Senior Policy Analyst, Marketplace Frameworks Policy Branch, at ISED) will be attending the Workshop.
