Canada Adopts Landmark Anti-Spam Legislation

On December 16, 2010, Bill C-28, the Fighting Internet and Wireless Spam bill, received Royal Assent.  Bill C-28 sets forth a number of key restrictions applicable to commercial electronic messages.  Specifically, it prohibits sending a commercial electronic message to an electronic address unless the recipient has provided consent.  Because the provisions are stringent, and the penalties for violations quite substantial, organizations should take the time to re-evaluate existing electronic communication practices for compliance with the new Act.  At this time, the anticipated effective date for the new legislation is in six to eight months when regulations are issued.
